INTRODUCTION  

Australia is one of the most preferred destinations for the aspirants who wish to migrate to other country on permanent residence to build their future.  Australia offers high standard of living, excellent health and education system, temperate climate, beautiful landscape, stability on the political and economic side and best quality of the life. Australia is also looking for the variety of skilled people who wish to migrate and enjoy Australian quality life. There are several ways for Australian visas which lead to Permanent Residency in Australia. The Permanent Residency visa can be later on converted into Citizenship and individual will get Australian Passport.

Citizens of New Zealand are allowed to enter and remain in Australia indefinitely under the Trans-Tasman Travel Arrangement, being granted a Special Category Visa on arrival, but must obtain a proper permanent residency permit if they wish to enjoy the privileges of permanent residents.

In case of the criminal misconduct on the part of the Permanent Resident visa holder the PR visa may be revoked at the discretion of the Minister for Immigration.

Permanent residency may be conditional on a certain type of employment or maintenance of a business, and permanent residents may be required to fulfill specific residence obligations to retain their status

BASIC CRITERIA:
 
You are required to fulfill following basic criteria in before you apply for the Permanent Residence Visa to Australia.  

Age

Under 45 Years of age at the time of making application

 

 

English Language

Sufficient ability in the English Language for working in Australia.

 

 

Qualifications

Post-secondary (University or Trade qualifications), or substantial relevant work experience in few cases. 

 

 

Occupation

You must have an occupation which fits your skills and qualifications and your occupation must be falling under Skilled Occupations List.

 

 

Recent Work Experience

You have relevant work experience (at least 12 months of work experience in a skilled occupation). You must show that you have worked in a skilled occupation for a required period of time. The amount of work experience is depending on the occupation you have. (If you are student you may qualify for the waiver of this requirement.

Before you apply for the Permanent Residence to Australia you are required to get your qualification assessed from the relevant body nominated for the purpose of the assessment of the skill for the purpose of immigration.  

In order to qualify for the skilled migration you must pass the skilled immigration point test i.e. you must have enough points to achieve automatic pass mark. The points are calculated on the basis following criteria.

There are certain occupations which require registration (e.g. Nurses and Physiotherapists) which need to have registration before you submit your application for Permanent Residence.

SKILLED INDEPENDENT (MIGRANT) VISA SUB CLASS – 175

For the purpose of getting visa under General Independent Skilled Migration you are required to score 120 points.

If you do not meet the points required for Skilled Immigrtaion at the time of assessemnt – Independent (Migrant) Visa - sub class 175 or  Sponsored (Migrant) Visa – Subclass 176, but you are above  the ‘pool mark’, (at present pool mark required for sub class 175 is 120 and sub class 176 is 100.  Your application will be held in the pool for a period of two years after assessment. If during the period of 2 years pass mark is lowered then the new pass mark, your application will be processed further.

The criteria are described as under.

ENGLISH LANGUAGE ABILITY:

Under these criteria points are allocated to you as under.

Proficient:  At least 7 band in each of the four components i.e. Speaking, Reading, Listening and Writing of the IELTS Test OR ‘B’ or higher on each of the four components of OET Test.

Competent: At least 6 band in each of the four components i.e. Speaking, Reading, Listening and Writing of  the IELTS Test OR  ‘B’ or higher on each of the four components of OET Test.

Vocational and nominated a trade occupation: At least 5 band in each of the four components i.e. Speaking Reading, Listening and Writing of IELTS test.

All dependent included in your application aged 18 years or over, must also provide evidence of their current level of English. If they are not having functional English would be required to pay second instalment visa application charges and will take tuition in Australia to achieve funcational English language ability.

Applicants who hold passport from UK, Canada, New Zealand, USA and Republic of Ireland will not required to under IELTS test to demonstrate that they meet the English language requirement.

Nominated skilled occupation

For falling under this criteria your nominated occupation must fall under Skill Occupation List and Australian Assessing authority has detremined that your skills are suitable for that occuation.

You have degree or trade qualification which meets the relevant Australian standards. In exceptional circumstances experience without formal qualifications may be acceptable.

 

 

 

For more general professional occupations

You must have a qualification equivalent to an Australian bachelor degree or higher qualification.

 

 

 

For other general skilled occupations

You must have a qualification equivalent to an Australian diploma or advanced diploma.

Specific work experience

Under these criteria for getting points you are required to prove that you have been employer for three years of the last four years in an occupation on the Skilled Occupation List.  Further you must be employer for atleast 20 hours a week in a paid position and at a skilled level in your nominated occupation or in a closely related occupation on Skilled Occupation List.

Under this criterion points are allocated to you as under. 

OCCUPATION / WORK EXPERIENCE

POINTS

If your occupation is scoring 60 points and you have been employed in your nominated occupation or closely related occupation which is on Skilled Occupation List at least for a period of 3 years out of 4 years before day of your application.

If your occupation is scoring 40, 50 or 60 points and you   have been employer in your occupation which is on Skilled Occupation List at least for a period of 3 years out of 4 years before day of your application.

Australian work experience

You are eligible to be awarded Australian work experience points if you have been employed in Australia

  • in an occupation listed on the Skilled Occupation List (SOL)
  • while holding a visa that allows you to work
  • for at least 20 hours a week
  • in a paid position
  • at a skilled level in your nominated occupation or in a closely related occupation on the SOL
  • for a period(s) totaling at least one (1) year in the four (4) years immediately before the day you lodge your application

 

AUSTRALIAN WORK EXPERIENCE

POINTS

Employed in an occupation listed on Skilled Occupation List or closely related occupation atleast for a period of one year in last four years before lodgement of your application.

Completed a recognised Professional Year in Australia in the past two (2) years immediately before the day of your application.

Australian qualifications

You can score points for an Australian Qualificaiton if you have completed one Australian Qualification while you are in Australia and all the instruction was in English. You can get points for the Australian Qualifications.

Under this criterion points are allocated to you as under.  It should be noted that the points can be allocated only against of these categories.

QUALIFICATION

POINTS

While you were present in Australia, you have met the requirements for award of a doctorate by an Australian educational institution as a result of course study of at least 2 years.

While  you were in Australia you have undertaken study for a total  period of three years and

  • Have met the requirement for award of a Master Degree by an Australian Educational Institution as a result of course study  of at least one year. 
  • Have met requirement for award of an undergraduate degree by an Australian Educational institution as result of course of at least one year.

While  you were in Australia you have undertaken study for a total  period of three years and

  • Have met the requirement for award of an honours degree (second class (division 1) level by an Australian Educational Institution as a result of course study of at least one year. 
  • Have met the requirements of award of an under graduate degree by an Australian Educational Institution as a result of course of at least one year.

Occupation in demand/job offer

If at the time of lodging your application or assessment if your occpuation is on Migration Occupations in Demand List (MODL) and you have recent work experience related to your occupation, you can be awrded additional points under these criteria. If you have job offer from an employer in Australia you will be eligible for higher number of points.

REGIONAL AUSTRALIAN STUDY

You can be awarded 5 (Five)  points if you have met the two (2) year study requirement while living and studying in a 'regional Australia/ low population growth metropolitan area' in Australia.

PARTNER SKILLS

If your spouse or interdependent partner satisfy the basic requirement of age, English language ability, qualifications, nominated occupation and recent work experience you can claim 5 (Five) points for the partner skill. You can not claim points under these criteria if your spouse of interdependent partner is an Australian Permanent Resident or an Australian Citizen of they are not included in yur visa application. It should be noted that you are required to obtain suitable skill assessment from the relevant assessing authority.
